This Endorsement Release ("Release") is entered into by the customer ("Customer") providing comments, testimonials, endorsements ("Endorsements") of Clarity products and Clarity, a Division of Plantronics, Inc., with its principal place of business at 4289 Bonny Oaks Drive, Chattanooga, TN 37406.
- It is Plantronics' policy not to accept unsolicited ideas or new product proposals from outside the company. Do not use this form to submit an unsolicited idea or new product proposal. If, despite our request that you not send us your ideas and materials, you still send them, please understand that Plantronics makes no assurances that your ideas and materials will be treated as confidential or proprietary.
- Customer grants to Plantronics, Inc., its affiliates, subsidiaries, licensees, successors and assigns (collectively "Plantronics") a royalty-free, unrestricted, worldwide, perpetual, irrevocable, non-exclusive and fully transferable, assignable and sublicensable right and license to use, reproduce, publish, distribute, display, translate, summarize, modify and adapt the Endorsement (in whole or part) and/or to incorporate it in other works in any form, media, or technology now known or later developed, in our sole discretion, with or without your name. Customer further waives the right to inspect or approve the finished advertising copy, or printed matter that may be used in connection therewith, or to the eventual use that it might be applied.
- Customer represents and warrants that their Endorsements, both written and oral, public quotes and statements, and biographical material associated with the Endorsement and are true and accurate and reflects Customer's honest belief and actual personal experience and that no other party has any rights thereto, and that any "moral rights" in such Endorsement have been waived.
- Customer agrees that Plantronics shall be the sole owner and have all right, title and interest in the Endorsement.
- Customer agrees to release Plantronics from any and all liability for claims by Customer or any third party in connection with Plantronics use of the Endorsement.
- Customer represents and warrants that he or she has read this agreement and understand its terms. This agreement shall be binding on the heirs, executors, administrators, successors or assigns of Customer. Customer further agrees that he or she has no affiliation or connection with Plantronics, or any person or entity connected with Plantronics.
- Customer represents and warrants that he or she is at least eighteen years of age, or if acting on the behalf of a minor, has the legal authority to contract on behalf of the minor.
